FMHero LLC and its subsidiaries, divisions, and affiliates (collectively, “FMHero”, “we”, “us”, and “our”) recognize the importance of protecting the privacy of the personal information you provide to us. Accordingly, we have developed this Privacy Policy (the “Policy”) so that you can make educated and informed decisions about the personal information that you entrust to us by engaging our services on the websites, social media, email exchanges, mobile apps, and other online services on which this Policy is posted or linked (the “Service”), and understand how we collect, use, disclose, and otherwise manage this information.
Your use of the Service is conditioned upon your agreement to this Policy and our Terms of Service. Before using our Service, please read this Policy carefully as it contains important information on who we are and how and why we collect, store, use, and share your personal information. This Policy also explains your rights in relation to your personal information and how to contact us or supervisory authorities in the event you have a complaint.
This Policy is written in the English language. We do not guarantee the accuracy of any translated versions of this Policy. To the extent that any translated versions of this Policy conflict with the English language version, the English language version of this Policy shall control.
Changes To Our Privacy Policy or Service
We reserve the right to change or modify this Policy or our Service at any time, and any changes are effective upon being posted unless we advise otherwise. If we make any material changes to this Policy, we will notify you by email or post notice on this website before the change becomes effective.
We encourage you to frequently review this website for the latest information on our privacy practices. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. You are bound by any changes to our Privacy Policy when you use the Service after such changes have been first posted. If you do not accept the terms of our Privacy Policy, we ask that you do not register with us and that you do not use our Service. Please exit the FMHero Service immediately if you do not agree to the terms of this Privacy Policy.
Children and Individuals Under the Age of Eighteen
General Info
The Service is not meant for individuals under the age of eighteen, and the Service may use mechanisms to prevent the registration and use of the Service by such underage individuals. FMHero will never knowingly request or collect personal information from any child. If you are under eighteen years old, please do not provide your information on our Service. Upon notification that a child has provided us with personally identifiable information, we will delete the child’s personally identifiable information from our records. Parental Controls.
In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we become aware that we have collected such information without verified parental consent, we will delete it promptly. Parents may review, request deletion of, or refuse further collection of their child's information by contacting [email protected]. We may require verification of parental identity before processing such requests..

Information you provide to us
FMHero will collect personal information from you directly when you interact with our Service, contact us, use our services, create an account, subscribe, share reviews, sign up to receive offers or emails from us, complete surveys, or order or purchase our products.
Information we obtain indirectly
We may receive personal information about you from our third-party affiliates or partners and from marketing companies that provide us with such information as a part of their relationship with us.
We may combine this with data that we already have collected about you. Such collected data could include contact details (such as email address) and previous purchase history or interests.
Information collected automatically
When you use our Service, we collect certain information about you automatically through our use of cookies and similar technologies.
Categories of Personal Information Collected and Purpose for Collection
FMHero collects the following categories of personal information: (1) contact information including your name, email address, street address, city, state, and zip code; (2) financial information for payment processing; (3) authentication information, including the user name and password that you use to register an account on the Service; (4) comments, reviews, suggestions; (5) personal preferences including product preferences, online preferences, and interests; (6) online behavior information including online activity, preferences, and time spent viewing features; (7) device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, and information about how and when you use our Service. For information about how we collect and use geolocation data, please see the "Collection and Use of Geolocation Information" section below; and (8) facilities management and other technical data, such as site information, equipment information, the services provided, the individual performing service and their related credentials and certifications, the refrigerant movements including cylinders utilized, stored or entered and the final disposition of those refrigerants and cylinders all using various technologies.
Unless you are a job applicant, employee, owner, director, officer, or contractor of FMHero, or as otherwise stated in a separate agreement, FMHero does not collect sensitive personal information such as your social security, driver’s license, state identification card, or passport number; your account login, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; your racial or ethnic origin, religious or philosophical beliefs, or union membership; the contents of your mail, email and text messages, unless we are the intended recipient of the communication; your genetic data; your biometric information for the purpose of uniquely identifying you; your criminal record; and personal information collected and analyzed concerning your sex life or sexual orientation. We ask that you not send nor disclose this sensitive personal information to us.
FMHero only collects and processes the minimum amount of personal information from you that is necessary to the purposes of our information processing activities and retains such information only if required to fulfill such purposes. Examples of our information processing activities include conducting our business, processing orders, personalizing your experience on our website, mobile application and web application, marketing, delivering messages, customer communications and support, user verification, providing marketing assistance, payment processing, quality management services, Service maintenance and improvements, and complying with legal requirements. We conduct such processing operations to perform the contract that you have with us, or to take steps at your request before entering into a contract, and for our legitimate interests or those of a third-party. A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.
Where applicable, if FMHero intends to further process your personal information for a purpose other than that for which the personal information was initially collected, FMHero shall, prior to such processing, provide you with any relevant information on such additional purpose, and, to the extent required by applicable law, obtain your consent for this.
Generally, your supply of personal information under this Policy will be mandatory because without this information we cannot provide the Service to you, and you will not be able to use the Service in a completely anonymous or pseudonymous manner, as such use would be impracticable. For example, we need your contact information as well as the services performed in order to produce compliant environmental protection reports where you were the technician who performed the service. Our information collection and privacy practices are either required or authorized by law, including but not limited to, data protection laws and environmental protection laws.
Collection and Use of Geolocation Information
Why We Collect Location Data.
FMHero's Platform is designed for facilities management professionals who provide maintenance, repair, and service of equipment at physical locations. To provide the core functionality of our Service and to help you comply with environmental and safety regulations, we collect and process geolocation information, including:
- The precise location of your Device when you use the Mobile Application to document service work
- The addresses and coordinates of facilities and equipment you service
- The location where maintenance, repair, or service activities are performed
- Time-stamped location data associated with service records
This location data is essential to: (1) enable accurate documentation of where work was performed for regulatory compliance purposes (such as EPA refrigerant tracking and recovery requirements); (2) create service records and reports that meet federal, state, and local legal requirements; (3) allow you to efficiently locate and select facilities and equipment in our crowdsourced database; and (4) prevent fraud and ensure the accuracy of service documentation.
Device Permissions.
When you download and use the Mobile Application, we will request permission to access your Device's location services. You may grant or deny this permission through your Device settings. However, denying location access will significantly limit your ability to use the Service, as location information is necessary for core features including service documentation, regulatory reporting, and facility management.
Sensitive Location Data.
We recognize that facilities management professionals may provide services at locations that could be considered sensitive, such as medical facilities, schools, places of worship, government buildings, and private residences. While we collect location data at these facilities for the legitimate business purpose of documenting service work performed there, we:
- Do not use location data to infer, derive, or profile your religious beliefs, political affiliations, health conditions, or other sensitive personal characteristics
- Do not sell or share raw, precise location data to data brokers, advertisers, or other third parties for marketing purposes
- Do not use location data for targeted advertising
- Do not track your location when you are not actively using the Mobile Application to document service work
How Location Data Is Shared.
Location data is shared in the following limited circumstances:
- Crowdsourced Model: Facility addresses and equipment locations become Shared Content accessible to other Users of the Platform to enable efficient service documentation (as described in our Crowdsourced Data Model disclosure). However, Customers using FacilityOps subscriptions may designate facilities as Private to restrict visibility.
- Service Providers: Location data may be shared with cloud hosting providers, mapping services, and other vendors who assist us in providing the Service.
- Legal Requirements: We may disclose location data when required by law, such as in response to subpoenas, court orders, or regulatory requests, or to comply with environmental protection reporting requirements.
- Anonymized Data: We may aggregate and anonymize location data and use or share it for industry analysis, service improvement, and other business purposes. Once anonymized, this data cannot reasonably identify you or any specific location you visited.
Your Location Data Controls.
- Device Permissions: You can disable location access through your Device settings, though this will limit Service functionality.
- Private Facilities: If you have a FacilityOps subscription, you can designate facilities as Private to limit their visibility to other Users.
- Account Deletion: If you delete your Account, we will delete or anonymize your personal location data within 30 days, except where retention is required for legal compliance, regulatory reporting, or to resolve disputes.
Data Retention.
We retain location data associated with service records for as long as reasonably necessary to: (1) provide ongoing Service to you; (2) comply with federal, state, and local record-keeping requirements for environmental and safety compliance (which may require retention for 3-7 years or longer); (3) resolve disputes or enforce our agreements; and (4) as otherwise required by law. Location data in anonymized form may be retained indefinitely. See “Data Retention” for additional information.
Third-Party Verification.
When we share facility or equipment location data with other Users as part of our crowdsourced model, we may use location-based verification (such as confirming a technician is physically present at a facility) to prevent fraud and ensure data accuracy. This verification does not grant access to Private facilities unless explicitly authorized by the Customer.

Disclosure of Personal Information
Third-Party Service Providers.
We may share your personal information with third-party service providers who perform services on our behalf, including payment processors, cloud hosting providers, customer support services, analytics providers, and other business partners necessary to operate the Service. These service providers are contractually obligated to use your personal information only as necessary to provide services to us and are prohibited from using or disclosing your information for any other purpose.
Legal Requirements and Protection of Rights.
We may disclose your personal information when required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
Business Transfers.
In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, your personal information may be transferred to the acquiring entity, subject to the terms of this Privacy Policy.
With Your Consent.
We may share your personal information with third parties when you have given us explicit consent to do so.
Crowdsourced Data Model.
FMHero operates on a crowdsourced data model where certain facility and asset information you enter into the Platform (such as facility names, addresses, equipment information including model, serial number, and equipment type, and limited service history including what service was performed, when, and where) becomes Shared Content accessible to other Users of the Platform for the purpose of streamlining service documentation and improving data accuracy. This Shared Content may be retained and used by FMHero even if you terminate your account or subscription. Customers using certain subscriptions may designate specific facilities or assets as Private, in which case those facilities and assets will not be visible to other Users except as expressly authorized by the Customer or by FMHero security features (such as physical presence verification). For more details on our crowdsourced model, please refer to our Terms and Conditions.
De-Identified and Anonymized Data.
We may create de-identified or anonymized data from personal information by removing information that makes the data personally identifiable to you. We may use and disclose this de-identified or anonymized data, including anonymized crowdsourced data, to third parties for industry analysis, research, analytics, marketing, demographic profiling, and other business purposes, without restriction. Once data has been de-identified or anonymized according to applicable legal standards, it is no longer considered "personal information" or "personal data" under this Privacy Policy and applicable privacy laws.
Cookies and Other Technologies
We may use “cookies” to help us process your order and to customize information that we may present to you. We may also use web beacons, pixel tags, mobile analytics software, log files, or other technologies to collect certain information about your online activity and interactions with our emails, online and mobile advertisements, and to allow us to keep track of analytics and certain statistical information that enables FMHero to improve our services and provide you with more relevant content and advertising offered by FMHero or through or linked from our services.
You may, however, disallow receiving cookies at any time through your web browser. Similarly, you may set your mobile device to refuse to provide certain information, but certain features of the Service may not work without such information. It is not our intention to use cookies to retrieve information that is unrelated to our Service or your interaction with our Service.

Linked Sites
The Service may contain links to third-party owned or operated websites, including, without limitation, social media websites (each a “Linked Site”), as a convenient method of accessing information that may be useful or of interest to you. This Policy and the practices that we follow under this Policy do not apply to Linked Sites. We are not responsible for the content, accuracy, or opinions expressed on any Linked Site or for the privacy practices or security standards used by third parties on such Linked Sites. These Linked Sites have separate privacy and data collection practices, and we have no responsibility or liability relating to them.
You understand and agree that by clicking on a link to a Linked Site, you have left our Service and this Policy is no longer in effect.
User Submissions
Some features of the Services may now or in the future allow you to provide content, such as images/video or written comments or reviews, to be published or displayed on public areas of the Service (“User Submissions”). Be careful about giving out information in public areas of the Service. The information you share in public areas may be viewed by any user of the Service. We cannot control the actions of other users of the Service with whom you may choose to share your User Submission.
Managing Your Information
If you do not want your personal information used by FMHero as provided in this Policy, you should not use the Service, register as a member of FMHero or for any specific tool or application on FMHero’s Service that collects personal information, or submit any information in the “Contact Us” form on the Site.
You may correct, update, or review personal information you have submitted through registration, interactive services and tools, and applications by signing into your FMHero account or by contacting us.
Security
If you choose to provide us with your personal information, you understand that we are transferring it to FMHero’s locations and systems in the United States or to the locations and systems of FMHero’s service providers around the world. FMHero uses reasonable security measures to protect the loss, misuse, and alteration of the information under its control. For example, we use encryption protocols for sensitive information, such as credit card or payment information. Such measures may change from time to time, depending on industry standards and perceived security risks. However, despite such security measures, FMHero cannot guarantee the security of your information and disclaims liability for loss, misuse, and alteration of your information under its control to the maximum extent permitted under applicable law. By using the Service, you agree to assume any security risk related to personal information. You should report any security violations to us by sending an email to [email protected].
The security of your FMHero account relies on your protection of your user profile information. You are responsible for maintaining the security of your user profile information, including your password and for all activities that occur under your account. You may not share your password with anyone. We will never ask you to send your password or other sensitive information to us in an email. Any email or other communication purporting to be from one of our websites requesting your password or asking you to provide sensitive account information via email, should be treated as unauthorized and suspicious and should be reported to us immediately by contacting us. If you believe someone else has obtained access to your password, please change it immediately by logging in to your account and report it immediately by contacting us.
Data Retention
General Retention.
We retain your personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements.
Service Records.
Due to federal, state, and local environmental and safety regulations (including EPA refrigerant tracking requirements), we retain service documentation, equipment records, and related data for a minimum of 3-7 years, and potentially longer as required by applicable law.
Account Data.
If you terminate your account, we will delete or anonymize your personal data within 30 days, except for:
- Data required for legal compliance or regulatory reporting
- Data necessary to resolve disputes or enforce agreements
- Shared Content in our crowdsourced database (which may be retained as described in our Terms and Conditions)
- Anonymized or de-identified data (retained indefinitely)
Inactive Accounts.
An account is considered inactive when there is no login activity for 1 consecutive year. Accounts inactive for 1 year may be deleted. We will attempt to notify you at your registered email address 30 days before deletion, but we are not responsible if you no longer have access to that email address.
Your Privacy Rights
If you are a resident of a state with a comprehensive privacy law, you have the following rights regarding your personal data:
Right to Know/Access.
You may request confirmation of whether we are processing your personal data and obtain a copy of your personal data, including information about: what data we collect, how it's used, who it's disclosed to, and the categories of sources.
Right to Correct.
You may correct inaccuracies in your personal data by logging into your account or contacting us.
Right to Delete.
You may request deletion of your personal data. We will delete your data from our records and direct service providers to do the same, unless retention is required by law (such as environmental/safety record-keeping requirements).
Right to Data Portability.
You may request that we provide your personal data in a portable format, to the extent technically feasible.
Right to Opt-Out.
You may opt out of:
- Sale of your personal data
- Sharing of your personal data for targeted advertising
- Profiling or automated decision-making that produces legal or similarly significant effects
Right to Limit Sensitive Data Use.
You may limit our use and disclosure of your sensitive personal data to only what is necessary to provide the Service you requested.
Right to Non-Discrimination.
We will not discriminate against you for exercising any of these rights.
Right to Opt-Out of Marketing.
You may opt out of receiving marketing communications from us by:
- Clicking "unsubscribe" in any marketing email
- Contacting us at [email protected]
- Adjusting preferences in your account settings
Note: You cannot opt out of transactional or service-related communications (account notifications, service updates, regulatory compliance communications).
Universal Opt-Out Signals.
We honor browser-based universal opt-out signals (such as Global Privacy Control) as valid requests to opt out of the sale and sharing of your personal data.
How to Exercise Your Rights:
Contact us at [email protected] or through your account settings. Provide enough information to verify your identity (name, email, phone number). We will respond within 45 days. You may designate an authorized agent to submit requests on your behalf with written permission.
Appeal Rights:
If we deny your request, you may appeal by contacting us within 30 days explaining why you believe we should reconsider.
If you remain unsatisfied after our appeal response, you may contact your state's Attorney General:

State-Specific Privacy Law Information
We comply with comprehensive privacy laws in the following states: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia.
The privacy rights described in the "Your Privacy Rights" section are provided to all users and meet or exceed requirements in all applicable state privacy laws.
California Residents: Beginning January 1, 2027, California law requires specific disclosures for automated decision-making technology (ADMT).
